MindMotive Terms of Use and Licensing Overview
Effective: March 2025

1. Scope of Services

MindMotive designs digital support tools, income-generating business models, and professional development resources for therapists, coaches, consultants, and business owners.

These include, but are not limited to:

  • Subscription-based digital partners (e.g. Abbie, Ava, Nova, Alex, Ben and all of our current and future digital partners)

  • Licensing of FAFO Tarot and other insight tools

  • Business-in-a-box service models (e.g. Emotional Reset Partner)

  • Mentoring and consulting offers for individuals and organisations

  • Sales Partner programme with commission-based opportunities

MindMotive does not provide therapy, medical treatment, or personal coaching under these services.

2. Consulting Terms

Consulting services are tailored to the specific needs of each client. A detailed agreement outlining deliverables, timelines, and fees will be provided before work begins.

  • Payment is agreed upon in advance unless otherwise stated.

  • Consulting fees are non-refundable once work has commenced.

  • All discussions and materials are confidential and must not be shared without written consent.

3. Mentoring Terms

MindMotive mentoring provides professional guidance on growth, service design, and ethical delivery. It does not replace therapy, clinical supervision, or personal coaching.

  • Full payment is required before mentoring begins unless an instalment plan is agreed in writing.

  • Refunds are not available once sessions have started.

  • At least 48 hours' notice is required to reschedule.

  • MindMotive is not responsible for implementation or outcomes.

4. Licensing Agreements (Digital Partners and Business Models)

Licences are available only to approved users. These may include personal users, solo professionals, businesses, or organisations.

  • Use is governed by the licence tier purchased.

  • Materials must not be resold, replicated, redistributed, or rebranded without permission.

  • Business and organisational licences include additional terms and review checkpoints.

  • Trial versions do not permit resale or content use in paid settings.

5. Digital Products (Workbooks, Workshops, Ebooks)

  • Delivered via digital download after purchase.

  • Refunds are not available once accessed.

  • Use is for personal/professional development only.

  • Materials must not be shared, repackaged, or resold.

6. FAFO Tarot Licences

There are two tiers:

1. Personal Use Only

  • No readings for others.

  • No public sharing or sales using FAFO branding.

  • No training or licensing claims.

2. Licensed FAFO Reader (Training Included)

  • May sell readings.

  • May reference official training and deck system.

  • Must adhere to usage, pricing, and representation guidelines.

No refunds are available on FAFO licences once issued. Re-purchase is allowed only in specific cases with approval.

7. Sales Partner Terms

Sales Partners earn commission by introducing new users to MindMotive digital tools or services.

  • Commission brackets are tiered based on deal value.

  • Targets apply to some roles, based on agreement.

  • Representation must reflect MindMotive’s tone and policies.

  • Sales roles are independent and non-exclusive.

8. Payments and Invoicing

  • Accepted payment: bank transfer, Square, approved invoicing.

  • Instalments may be available for selected services over £400.

  • 15% admin fee applies to instalment plans.

  • Failure to complete payments may result in paused or revoked access.

9. Anti-Imitation and Misrepresentation Policy

MindMotive, including its proprietary tools (e.g. Abbie, Nova, Ava, Alex, Ben), FAFO Tarot, and licensed business models (e.g. Emotional Reset Partner), operates with a zero-tolerance stance on imitation, misrepresentation, or unauthorised replication.

This includes, but is not limited to:

  • Using MindMotive names, language, tools, or content without written permission

  • Attempting to replicate delivery style, format, or structure

  • Misrepresenting affiliation with MindMotive or any of its digital tools or training

  • Using AI-generated content that falsely implies association with Karen Ferguson or the MindMotive brand

We reserve the right to take legal action in cases of:

  • Copyright infringement

  • Brand impersonation

  • False claims of authorship, training, or partnership

  • Market confusion or misleading representations

10. Dispute Resolution

Any disputes regarding services, licensing, or content use will be resolved through mediation or arbitration. All legal matters are governed by the laws of England.

PRIVACY POLICY

​We receive, collect and store any information you enter on our website or provide us in any other way. In addition we collect the Internet protocol (IP) address used to connect your computer to the Internet; login; e-mail address; password; computer and connection information and purchase history. We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page. We also collect personally identifiable information (including name, email, password, communications); payment details (including credit card information), comments, feedback, product reviews, recommendations, and personal profile. collect customers’ data and use it once their purchase has been completed.

 

When you conduct a transaction on our website, as part of the process, we collect personal information you give us such as your name, address and email address. Your personal information will be used for the specific reasons stated above only.

We collect such Non-personal and Personal Information for the following purposes:

  1. To provide and operate the Services;

  2. To provide our Users with ongoing customer assistance and technical support;

  3. To be able to contact our Visitors and Users with general or personalized service-related notices and promotional messages;

  4. To create aggregated statistical data and other aggregated and/or inferred Non-personal Information, which we or our business partners may use to provide and improve our respective services; 

  5. To comply with any applicable laws and regulations.

Our company is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall.  

 

All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

We may contact you to notify you regarding your account, to troubleshoot problems with your account, to resolve a dispute, to collect fees or monies owed, to poll your opinions through surveys or questionnaires, to send updates about our company, or as otherwise necessary to contact you to enforce our User Agreement, applicable national laws, and any agreement we may have with you. For these purposes we may contact you via email, telephone, text messages, and postal mail.
